Housekeeping Amendment to Correct Mapping Schedules

The Township will be considering an amendment to By-Law 2011-52 as amended by By-Law 2022-61 at its Council meeting on January 24, 2022 to correct the mapping to include the correct EP-1 overlay. A copy of draft by-law and updated schedules can be viewed in the Important Documents Section to the right.

PLEASE NOTE:

Following the approval of By-Law 2022-61, it came to staff’s attention that there was a technical error in the schedules (maps) relating to the EP-1 overlay projection. As a result the maps do not show the proper location of this layer. Council has directed that a housekeeping by-law be processed as soon as possible following the expiration of the appeal period on November 16th. The correct version of the schedules which will be included in the housekeeping bylaw are provided here:

Thank you everyone for all your online contributions to this consultation. Although we've completed and submitted all your survey and comment submissions, the bylaw review process is scheduled to continue into the fall. Next steps are listed in the Lifecycle pane on this page. You're most welcome to pose any questions you may have via the Questions tab on this page, or via email zoningupdate@centralfrontenac.com.

The Official Plan for the Township of Central Frontenac was approved by the County of Frontenac in September, 2021. The next step in implementing the plan requires that the Township review its comprehensive zoning by-law. That's where you come in. We need your help and participation to complete that review.

The zoning by-law describes what uses may be permitted for individual lots of land, what buildings and structures may be constructed on them, and how far those structures must be set back from lot lines. It also describes rules for things like maximum permitted building height, requirements for parking, where docks and boat houses may be placed, whether and how recreational vehicles may be used or parked, whether home-based businesses may be permitted on individual lots, and many other matters. The zoning by-law applies to all land parcels in the Township and the regulations in it are intended to ensure safety for people and the natural environment, and to ensure that land is used sensibly and constructively among neighbours.

Reviewing the zoning by-law is a chance for all residents of Central Frontenac to determine how zoning affects their properties and to ask and answer such questions as:

  • What are the zoning rules for my property and do those rules reflect how my property is actually used?
  • Can I change zoning rules for my property? If so, how?
  • Do the zoning rules for things like lot sizes, frontages, setbacks and density help or hinder development plans and possibilities?
  • How do zoning rules help to protect the natural environment?
  • What rules should apply for storage containers, fences, swimming pools, and accessory buildings on my land?
  • Should new zoning rules be applied retroactively? If so, how?
  • How can zoning rules be shaped to help to resolve land-use conflicts?

You can help us by providing your comments, your concerns and your suggestions on potential improvements or changes to the zoning by-law. As a starting point, please take the opportunity to review the zoning by-law and the zoning schedules for which there links on the right. You can also send us your questions and any submissions you may have via email to zoningupdate@centralfrontenac.com or drop off/mail to address the municipal office.

The Open Houses are being held pursuant to the provisions of Sections 26 (9) and 34 (12) of the Planning Act, R.S.O. 1990, Chapter P.13.

THE PURPOSE of the Open Houses is to invite comments from the public on proposed changes to the Township’s comprehensive Zoning By-law #2011-52. The proposed changes result from the requirement of Section 26 (9) of the Planning Act that a municipal council amend the zoning by-law within three years of the revision to an official plan to ensure that the zoning by-law conforms to the official plan. Proposed changes include but are not limited to: expanding the scope of permitted home-based businesses; permitting live/work units; regulating food vehicles; providing for additional residential units; permitting tiny houses; providing for storage containers and recreational vehicles; providing for the keeping of domestic livestock for local food production, and providing for the installation of alternative energy sources and systems (i.e., solar collectors, wind turbines, geothermal systems and electric vehicles recharge stations). The review also provides an opportunity to modernize the by-law with the addition of new definitions and uses such as cannabis, community gardens, private home day care, dog park, fitness centre, pet grooming establishment etc. The review includes updates to the zoning schedules, reflects changes in the Planning Act procedures, and updates names of government organizations. There are no proposed changes to the zone categories. A number of new permitted uses to several zones are proposed. Some changes to the zone standards are proposed to comply with the official plan and to introduce new standards such as development on narrow water channels and a floor space index. Changes are also proposed to all of the zoning schedules (mapping).

The proposed changes will result in an amendment to By-law 2011- 52 rather than a new comprehensive zoning by-law. Since the by-law amendment affects all properties in the Township, a key map is not provided.

IF YOU WISH TO BE NOTIFIED of the decision of the Council of the Township of Central Frontenac on the proposed zoning by-law amendment, you must make a written request to the Clerk of the Township (see address below).

If a person or public body would otherwise have an ability to appeal the decision of the Council to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Central Frontenac before the proposed zoning by-law amendment is passed, the person or public body is not entitled to appeal the decision.

If a person or public body DOES NOT MAKE ORAL SUBMISSIONS AT A PUBLIC MEETING OR MAKE WRITTEN SUBMISSIONS to the Township of Central Frontenac before the proposed zoning by-law amendment is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

FOR MORE INFORMATION ABOUT THIS MATTER, including information about your appeal rights, please contact the Clerk of the Township at the address below. The proposed amendment and zoning schedules may be inspected at the Municipal Office during regular business hours and is available for viewing on the Township’s website at www.centralfrontenac.com and on the township’s EngageFrontenac 2022 Zoning By-Law Update project page at https://engagefrontenac.ca/hub-page/township-of-central-frontenac

Do you think trailers should be allowed as principal uses in certain zones in Central Frontenac? If so, what considerations are important to ensure trailers are allowed in a safe, environmentally friendly way, that doesn't cause issues with neighbours? Should landowners who use RVs as residences on their properties be required to obtain a licence to do so? Please share your ideas, input, and advice in the comments below. All will be collected and carefully considered as part of the 2022 Central Frontenac Zoning By-law Review process.

Recreational Vehicles include self-propelled or towed vehicles capable of being used for living, sleeping, eating or accommodation of persons on a temporary, transient or short term basis, even if the vehicle is jacked up or its running gear is removed. Examples include a motor home, tent trailer, a camper trailer, a recreational trailer, a fifth wheel, or a bus converted into a motor home.

Our current by-law allows recreational vehicles in some zones as an accessory use only. In some zones they are to be in a stored state. Over the last few years, trailers have become more prevalent as an affordable alternative to traditional construction. Our new zoning bylaw will need to address whether recreational vehicles should be allowed as a principal use, if so, in what zones, and what regulations need to apply to ensure they are safe for residents and they don't have a negative impact on the environment or neighbours. Properties with trailers are treated and taxed as vacant lands. As trailers proliferate, the services of the municipality increase (use of roads, waste, recreation, fire and protection services) with no additional tax revenue to cover these costs. Many of these trailers are rented out for an additional income source. This is not fair to taxpayers who pay taxes based on improvements. One way the township can manage trailers to balance the rights of all is through licensing. Licensing can ensure certain requirements are met before allowing a trailer on a property, such as demonstrating there is safe water/sewage servicing, civic addressing, fire safety etc. A licensing fee can help address the lack of tax revenue from these properties and cover inspection and administrative costs of the licencing process.
